NH RSA Chapter 91-A: Access to Public Records and Meetings
- Have a quorum: for BPL Trustees, 3
- Be in a noticed, public session
- Recorded, roll call majority vote on a motion to go into non-public session based on one of the following:
- dismissal, promotion, compensation or investigation: RSA 91-A:3, II(a)
- hiring: RSA 91-A:3, II(b)
- adversely affects reputation NOT of a member of the board: RSA 91-A:3, II(c)
- buy/sell/lease property: RSA 91-A:3, II(d)
- pending claims/litigation threatened or filed: RSA 91-A:3, II(e)
- (f), (g), and (h) should never arise at BPL Trustees
- how emergencies are handled: RSA 91-A:3, II(i)
- keep minutes
- 2/3rd recorded vote to seal
- majority to UNseal
- 72 hours to publicly disclose UNsealed minutes
Legal Counsel
Consultation with legal counsel is not a meeting under RSA 91-A. If, in the course of public session, a board wants to consult with legal counsel, it should vote to (possibly temporarily) adjourn the meeting. I believe Roberts would call this a Recess.
